Terms of service

Effective August 28, 2026

These terms govern your use of the Groundswell hospital heat-risk application, its reports, and its MCP server. The service is operated by Groundswell Earth, Inc. By using it, you agree to these terms. If you do not agree, do not use the service.

What the service does

The service estimates temperature-related mortality risk near selected hospitals using weather, population, mortality, and modeled temperature data. It is a FortyGuard Hackathon 2026 project, not a clinical product. We may change, suspend, or stop any part of it at any time.

Planning information, not medical advice

Reports are estimates for research, demonstration, and public-health planning. They are not medical advice, diagnosis, treatment guidance, an emergency warning, or a substitute for local public-health and clinical judgment. Do not use the service to make decisions about an individual patient or as the sole basis for emergency, staffing, resource, or safety decisions. For an emergency, contact the appropriate local emergency service.

Data and model limitations

Forecasts, source data, population estimates, mortality models, and model outputs contain uncertainty and may be delayed, incomplete, or wrong. A report applies only to its stated location, dates, assumptions, model release, and catchment. Read the methods, limitations, provenance, and confidence information shown in the report and documentation before relying on it.

Acceptable use

You may not misuse the service, interfere with its operation, bypass access or rate controls, probe it for vulnerabilities without written permission, submit unlawful or harmful material, or use it in a way that violates another person's rights. Do not submit protected health information, patient records, secrets, or other confidential personal data. You are responsible for MCP connections you authorize.

Report names, links, and access

You keep any rights you have in a report name you submit and give Groundswell permission to store, process, and display it to operate the service. Reports are not private. They persist on the server and can be reopened through a unique link. The service does not publish a global report list, but anyone with the UUID may be able to view the report.

Software, data, and third-party services

Groundswell and its licensors retain their rights in the service, software, design, and original content. Source data and third-party services remain subject to their owners' terms and licenses. Your use of a report does not grant rights to underlying data beyond those licenses. Provider names and source receipts in a report identify provenance and do not imply that a provider endorses the report.

Disclaimers and liability

The service is provided "as is" and "as available." To the fullest extent the law permits, Groundswell disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, merchantability, and non-infringement.

To the fullest extent the law permits, Groundswell and its officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or decisions made using the service. These limits do not exclude liability that applicable law does not allow us to exclude.

Changes to these terms

We may update these terms as the service changes. We will post revised terms here and change the effective date. Your continued use after revised terms take effect means you accept them.
